Use of diving services and general sales conditions

Divers who have booked the dive with the boat are required to show up at least 45 minutes before the scheduled boarding time.

Divers are obliged to participate in the pre-dive briefing held before the dive, at a location indicated by the diving staff.

Failure or delay in adhering to the reception presentation time, participation in the pre-dive briefing, or boarding is grounds for contract termination. Termination results in the diver’s exclusion from the dive, cessation of the right to use the diving service, and the obligation to pay compensation, which, except for any additional due, equals the price of the booked dive. The management, at its sole and unquestionable discretion, may allow, if the conditions permit, participation in a subsequent dive organized on the same day.

To ensure the smooth running of scuba activities and for safety reasons, the management of BLUNAUTA D.C. reserves the right, at its sole discretion, taking into account weather and environmental conditions, to make changes to the agreed and booked programs by users, including changes to schedules, days, and/or dive sites. Furthermore, for the same reasons and with the same unquestionable judgment, it reserves the right to interrupt or even cancel the activities themselves.

In case of changes, interruption, or cancellation of dives and all services provided by the Diving Center, BLUNAUTA D.C. may, at its discretion, indicate a new date when the services will be provided or provide a refund for the service not provided, only if previously paid.

Under no circumstances does BLUNAUTA D.C. respond for additional damages (such as travel or accommodation expenses, etc.) resulting from the non-provision of the service and the enjoyment of the planned activities.

In case of bookings via email (WhatsApp, etc.) for services and/or dives provided by BLUNAUTA D.C., the following must be indicated at the time of booking: a) personal data of participants (data will be stored in accordance with the GDPR 2016/679); b) the school or club of membership and/or the instructor or reference guide; c) the instructor or guide who will accompany the user on the dive; d) it must be specified whether guidance from BLUNAUTA D.C. staff is requested; e) whether the dive is intended to be carried out autonomously and under one’s own exclusive responsibility; f) the level of the diver’s certification (which must be shown in original).

Instructors/guides/school managers must fill out and submit to the management a special form for clubs/schools/clubs, containing the names of the participants in the dive and the certification held by each.

The management warns that the following behaviors are not allowed in the diving center or on board boats:

  1. Making noise, chasing each other, or harassing other people using the service in any way;
  2. Behaviors contrary to decency;
  3. Rinsing wetsuits or any other equipment component in the showers or sink in the bathrooms.
  4. Leaving waste outside the designated containers.

Snorkeling Excursion

The activity of snorkeling consists of swimming on the surface, with the possibility of making short apnea excursions up to a maximum of 2 meters deep, using the breathing tube (snorkel) to breathe, aimed at observing marine life (including rocks and seabed) while fully respecting it: it is therefore prohibited to remove or retain any element of the related flora and fauna.

The mandatory basic equipment for snorkeling consists of a mask, snorkel, and fins; the Diving Center recommends, in any case, using a lightweight long wet suit (3mm or less neoprene) to promote buoyancy and prevent accidental abrasions and sunburn; alternatively, it is recommended to wear at least a short wetsuit (shorty) or a protective technical shirt (UV/UPF sun protection).

It is always advisable to carry out excursions with a companion, maintaining a distance not exceeding 1.5 meters.

It is mandatory to communicate to the onboard staff the route proposed for the excursion, committing, in any case, to stay within 50 meters of the boat; in case of moving beyond the aforementioned limit, it is mandatory to signal one’s presence with an inflatable buoy equipped with a flag with the international recognition signal.

It is necessary to always pay particular attention to marine conditions, especially the direction of the current, starting the excursion against the direction of the current to facilitate the return (with a favorable current).

The snorkel can be placed either on the right or on the left, it should be attached so that it is close to the face but should not be placed behind the ear.

Dives and Water Activities – General Rules

To participate in dives, divers must be in possession of a scuba diving certification or have undertaken an experience program or a training course aimed at obtaining the certification, provided that it is under the direct supervision, control, and full responsibility of the assigned instructor.

  1. Personal data and Special categories of personal data

According to Article 4 of Regulation (EU) 2016/679, “personal data” is defined as any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

In order to allow you to participate in sports/recreational activities, you may be required to provide some medical data or data related to your personal habits or lifestyle. In this regard, we inform you that pursuant to Article 9 of Regulation (EU) 2016/679, you will be asked to provide BLUNAUTA D.C. with data that may be qualified as “special categories of personal data,” namely data revealing “racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data intended to uniquely identify a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.” Such categories of data may be processed only with your free and explicit consent, expressed in writing at the bottom of this information.

  1. Purposes of the processing

The personal data provided by you to BLUNAUTA D.C. may be used for the following purposes:

a) to enable and manage your membership/registration/reservation for our services;

b) to allow you to benefit from products and/or services, as well as from activities reserved for you by virtue of your membership to the offers;

c) for administrative-accounting purposes and for compliance with obligations provided by current legislation;

d) following your eventual and specific consent, for sending informative and commercial communications, including promotional material, advertising material and/or offers of goods and services, by any means, including, for example, mail, Internet, telephone, email, MMS, SMS from Italy or abroad (including from countries not belonging to the European Union) by BLUNAUTA D.C., by companies/businesses Partner of BLUNAUTA D.C., controlled and/or participated by it, as well as by physical or legal entities contractually linked to BLUNAUTA D.C.;

e) following your eventual and specific consent, for profiling activities, or to allow the processing and completion of statistical and market research studies, as well as for the analysis of tastes, preferences, habits, needs, and consumer choices and to receive personalized offers based on purchasing preferences, by BLUNAUTA D.C., by controlling companies, controlled and/or participated by it, as well as, on behalf of BLUNAUTA D.C., by physical or legal entities contractually linked to BLUNAUTA D.C.;

and/or who, however, collaborate in BLUNAUTA D.C. commercial activities;

f) following your eventual and specific consent, for the transfer of data to commercial partners of BLUNAUTA D.C. for the purpose of receiving their communications.

We remind you that, with reference to the purposes highlighted in points a), b), and c), the provision of your personal data is mandatory. Your eventual refusal and/or the provision of inaccurate and/or incomplete information would prevent:

with reference to the purpose referred to in point a): your membership/registration/reservation for our services;

with reference to the purpose referred to in point b): to benefit from the products and/or services booked as well as from the activities reserved for you by virtue of your membership to the offers;

with reference to the purpose referred to in point c): for BLUNAUTA D.C., the execution of administrative-accounting activities and the correct fulfillment of regulatory obligations.

With reference to the additional purposes highlighted in points d), e), and f), the provision of your personal data, and consent to the processing thereof for the aforementioned purposes, is optional. However, your eventual refusal to provide your data and/or consent to the processing for the aforementioned purposes and/or the provision of inaccurate and/or incomplete information may prevent the Company:

  • with reference to the purpose referred to in point d): the sending of promotional communications by BLUNAUTA D.C.
  • with reference to the purpose referred to in point e): the conduct of profiling activities and the sending of personalized offers based on your purchasing preferences by BLUNAUTA D.C.
  • with reference to the purpose referred to in point f): the transfer of your data to commercial partners of BLUNAUTA D.C. for the purpose of receiving their communications.

The processing of your personal data will be carried out using suitable paper, electronic, and/or telematic tools, with logic strictly related to the purposes described above and, in any case, in such a way as to guarantee the security and confidentiality of the data themselves.

In the event that the user (i) accesses or registers for BLUNAUTA D.C. services using the access credentials of a social network (such as Facebook or Twitter, hereinafter “Social Network”) or (ii) associates their account with a user account on the same social network, BLUNAUTA D.C. may receive from such Social Network data relating to the user, in accordance with the terms of use and as provided for in the privacy policy of the Social Network itself. BLUNAUTA D.C. may add such information to the user’s data already collected through its services. If the user chooses to share information with such Social Networks, BLUNAUTA D.C. receives data from them in accordance with the user’s consent options. The data possibly communicated to the Social Network will be subject to the terms and conditions of use of the Social Network.
